1. Introduction

Welcome to MysteryQuest Room. These Terms of Service ("Terms") govern your use of our escape room facilities, services, and website located at 6 Puzzle St, Melbourne VIC 3000, Australia. By booking a session, visiting our premises, or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you ("User", "Customer", "You") and MysteryQuest Room ("Company", "We", "Us", "Our"). We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of our services after any changes constitutes acceptance of the modified Terms.

2. Booking and Reservations

All bookings must be made through our official website, phone, or email. A booking is confirmed only when you receive a confirmation email from us. We require a minimum of 2 participants and a maximum capacity varies by room (typically 6-8 people). Group size restrictions are in place for safety and optimal experience.

Payment is required at the time of booking to secure your reservation. We accept major credit cards, debit cards, and other payment methods as specified on our website. Prices are subject to change without notice, but confirmed bookings will honor the price at the time of reservation.

Cancellations must be made at least 48 hours before the scheduled session for a full refund. Cancellations made within 48 hours of the booking time are non-refundable, but may be rescheduled subject to availability. No-shows will forfeit the entire booking fee without exception.

3. Age Requirements and Supervision

Participants must be at least 8 years old to enter our escape rooms. Children under 14 must be accompanied by an adult (18 years or older) at all times during the experience. Some rooms may have higher age restrictions due to content difficulty or thematic elements, which will be clearly indicated during booking.

Adults accompanying minors are responsible for their behavior and safety throughout the duration of the session. We reserve the right to refuse entry to any participant who does not meet the age requirements or appears unable to safely participate in the activity.

4. Safety and Conduct

Your safety is our top priority. All participants must follow the safety briefing provided by our staff before entering any room. Emergency exits are clearly marked, and rooms can be exited at any time if needed. Participants with medical conditions (including claustrophobia, heart conditions, epilepsy, or pregnancy) should consult with our staff before participating.

Participants are expected to treat all equipment, props, and facilities with respect. Any intentional damage to our property will result in immediate termination of the session and the responsible party will be charged for repairs or replacement. We reserve the right to remove any participant who behaves inappropriately, uses offensive language, or poses a risk to themselves or others.

The following are strictly prohibited: physical force beyond intended puzzle mechanisms, running, climbing on furniture, consumption of food or beverages inside the rooms, smoking, and use of mobile phones or cameras during the experience (except in designated photo areas). Violation of these rules may result in immediate ejection without refund.

5. Liability and Assumption of Risk

While we maintain high safety standards, participation in escape room activities involves inherent risks. By participating, you acknowledge and assume all risks associated with the activity, including but not limited to: minor injuries, accidents, loss or damage to personal property, and psychological discomfort from themed environments.

MysteryQuest Room, its owners, employees, and affiliates shall not be liable for any injury, loss, damage, or expense incurred during your visit, except where such liability cannot be excluded by law. We strongly recommend that all participants have appropriate personal insurance coverage.

You agree to indemnify and hold harmless MysteryQuest Room from any claims, damages, or expenses arising from your participation in our activities or violation of these Terms. This includes legal fees and costs associated with defending against such claims.

6. Intellectual Property

All content, designs, puzzles, scenarios, graphics, logos, and materials used in our escape rooms and on our website are the exclusive property of MysteryQuest Room and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our explicit written permission.

Participants agree not to disclose puzzle solutions, room secrets, or specific gameplay details on social media, review platforms, or any public forums. Sharing your general experience and impressions is encouraged, but revealing specific solutions spoils the experience for future participants and may result in legal action.

7. Photography and Media Release

By participating in our activities, you consent to being photographed or recorded (video/audio) for promotional, marketing, or security purposes. These materials may be used on our website, social media, advertising, or other marketing channels without compensation to you.

If you do not wish to be photographed or recorded, please inform our staff before your session begins. We will make reasonable efforts to accommodate your request, though we cannot guarantee complete exclusion from all recordings due to security camera requirements.

8. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and applicable data protection laws. By using our services, you consent to the collection, use, and storage of your personal information as described in our Privacy Policy. Your personal information will be used for booking management, communication, marketing (with your consent), and service improvement. We implement appropriate security measures to protect your information from unauthorized access or disclosure.

9. Gift Certificates and Promotions

Gift certificates purchased from MysteryQuest Room are valid for 12 months from the date of purchase unless otherwise specified. They are non-refundable and cannot be exchanged for cash. Lost or stolen gift certificates cannot be replaced.

Promotional offers, discounts, and special packages are subject to specific terms and conditions which will be communicated at the time of the offer. Promotions cannot be combined with other offers unless explicitly stated. We reserve the right to modify or cancel promotions at any time.

10. Force Majeure

MysteryQuest Room shall not be liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, government actions, power outages, pandemics, civil unrest, or equipment failures. In such cases, we will make reasonable efforts to reschedule your booking or provide a refund at our discretion.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

We encourage customers to contact us directly to resolve any complaints or concerns. If a dispute cannot be resolved through direct communication, both parties agree to attempt mediation before pursuing legal action.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
